1. Interpretation
In these Terms and Conditions (Terms), the following words and phrases shall have the following meanings:
“You/Your” means the person who purchases and/or receives the Service(s) from Us:
“Us/We/Our” means Claire Taylor Therapy, 85 Stannington View Road, Sheffield, S10 1SQ;
“Agreement” means the Agreement between Us and You which shall be deemed to incorporate these Terms;
“Services” means the therapy services to be delivered by Us to You;
2. The Agreement
The Agreement shall be on these Terms to the exclusion of all other terms and conditions. The Agreement will commence when You make an appointment and shall terminate upon delivery of the Services or as otherwise detailed in accordance with these Terms.
3. The Service
We will provide specialised therapy services, which may include without limit; the provision of one to one treatment sessions, rehabilitation programmes and support, on dates and at locations to be confirmed.
4. Responsibilities
You are responsible for:
- Being on time to any planned meetings or events.
- Making any payments due to Us in a timely manner.
We are responsible for:
- Delivering the Services with all reasonable skill and care, and in full compliance with the National Code of Ethics for Hypnotherapists.
5. Confidential Information
We commit to complying with the requirements of the Data Protection Act in relation to any of Your personal data We hold.
Where Your appointment has been arranged through a referring agent You hereby grant to Us Your express permission for Us to communicate, and where necessary share information, with Your referring agent, (if applicable) and any medical professionals whose details You or Your referring agent have shared with Us for the purposes of this Service.
Where You have arranged Your appointment with Us directly and We require confirmation of medical details from Your GP/consultant/other health professional we will ask Your permission before making any contact.
Confidentiality will be maintained in all but the most exceptional circumstances in accordance with the GHR National Code of Ethics for Hypnotherapists. Such circumstances can only include: legal action (criminal or civil cases where a court order is made demanding disclosure - includes coroners courts) and where there is good cause to believe that not to disclose would cause danger of serious harm to Yourself or others. Most standards of confidentiality applied in professional contexts are based on the Common Law concept of confidentiality where the duty to keep confidence is measured against the concept "greater good". The sharing of anonymous case histories with supervisors and peer-support groups is not a breach of professional confidentiality. The sharing of open case histories with supervisors and any referring NHS medical practitioner is also not a breach.
6. Price and Payment
The price for the Services will be subject to any applicable UK taxation, including where relevant, VAT.
Payment for individual consultations is required at the time of the appointment.
Discounts may be available for block bookings and if applicable will be communicated to You at the time of booking.
Payment can be made by cash, cheque made payable to Claire Taylor or by standing order or BACS (details available on request) unless otherwise advised at the time of booking.
Once a appointment has been accepted the cancellation terms contained below apply.
7. Cancellation
Individual Consultations:
may be cancelled on receipt of 48hrs notice. Where You give less than 48hrs notice We will make a cancellation charge of 50% of the fee for the appointment.
The cancellation charge will apply even where You make Your appointment less than 48hrs before the time for Your appointment.
Cancellation requests may be made by phone or in writing/email.
The date on which a letter/email is received by Us will be deemed as the date the request has been made.
Nothing in this clause restricts Your right to refuse treatment at any time, however in such instance cancellation charges will apply.
8. Liability
Neither party shall be liable for any indirect or consequential losses or expenses, including but not limited to, loss of or damage to anticipated profits, contracts, reputation, goodwill, labour costs or losses or expenses arising from 3rd party claims.
Notwithstanding the above and save in the case of death or personal injury cause caused by negligence for which the liability of the parties shall be unlimited, the parties liability under this Agreement shall be limited to the fees charged or £1000 whichever is the lesser.
For the avoidance of doubt We shall not be liable for any loss or damage incurred as a consequence of inappropriate treatment advice given as a result of Your failure to disclose relevant medical information, or for any other act or omission of Yourself in relation to any information, advice or recommendations supplied by Us as part of the Services, whether in writing, verbally or otherwise.
9. Force Majeure
If either party is subject to an event of Force Majeure, that is circumstances outside its reasonable control, including but not limited to war, fire, industrial disputes or civil commotion, it shall notify the other and the first party’s obligations under these Terms shall be suspended until it notifies the other party of the end of such event of Force Majeure.
10. General
If any part of this Agreement is found to be void or un-enforceable by any Court of competent jurisdiction, such part shall be severed from this Agreement which will otherwise remain in full force and effect.
These Terms shall remain in force until altered in writing and signed by both parties.
Unless otherwise agreed and subject to the application of the then current prices, these Terms shall apply to any future appointments made by You with Us.
This Agreement shall be governed by the laws of England and Wales.
I hereby consent to treatment from Claire Taylor Therapy under the Terms detailed herein:
